The Corporate Manslaughter and Corporate Homicide Act 2007
This is a landmark in law.
For the first time, companies and organisations can be found guilty of corporate manslaughter as a result of serious management failures resulting in a gross breach of duty of care.
The Act clarifies the criminal liabilities of companies including large organisations where serious failures in the management of health and safety result in a fatality.
The Health and Safety at Work Act 2007
This Act clearly states that individuals such as company directors and managers may be prosecuted if they turn a blind eye to occupational road risk management.
Where no evidence of an organisation planning, delivering, monitoring, and reviewing road safety can be found, charges could result.
It recognises the fact that drivers are often under pressure to achieve management targets that fail to take account of the diverse roads conditions that are met by employees throughout their working day.
